We would like to draw your attention to your rights regarding your personal data: unless otherwise stipulated by applicable regulations, you have the right to request access, rectification, deletion or restriction of data processing, as well as data portability, withdrawal of consent to data processing and to object. The scope of these rights may vary depending on the reasons and purposes for which the Company processes your data.

Based on Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation), hereinafter: “RODO”, and provisions of Polish law, including but not limited to. Law of May 10, 2018. On the protection of personal data (Journal of Laws Item 1000), we provide below information on the processing of your personal data by SP Corporate sp. z o.o. (inter alia, in connection with the provision of legal advice or in connection with the use of the website https://www.sp-corporate.com/, hereinafter also referred to: “the Website”) and information on cookies.

 

Who will be the controller of your data?

The administrator of your data will be: SP-CORPORATE sp. z o.o. based at ul. Strzegomska 56A, 53-611 Wrocław, with NIP number: 894-257-57-56, REGON: 020793976, e-mail address: biuro@sp-corporate.com; tel. no.:+48 71 346 70 80, hereinafter referred to: “the Company”.

 

For what purpose and on what legal basis will we process your data?

The purposes and legal bases for the processing of your personal data depend on the nature in which and for what reason the Company processes your personal data.

1) If you use the Company’s website – your personal data will be processed to enable you to use the Service. This gives us the pleasure of informing you about the Company’s profile, activities and achievements, which is a legitimate legal interest of the data controller and is the legal basis for the processing of your personal data (Article 6(1)(f) RODO). In this case, the legitimate interest of the Company for which your personal data may be processed is also the need to ensure security related to the operation of the Service.

The Company’s possession of your personal data is not a legal or contractual requirement, however, it is necessary for you to use the Service correctly. The processed data enable visitors to retrieve information from the Website servers, ensure the proper functioning of the Website, as well as the security of data belonging to the Company.

2) If the Company has obtained your personal data in connection with the provision of consulting services(e.g., to you, to the companies/companies where you are employed, or to participants in cases in which you are involved) then your data will be processed for the purpose of providing consulting services, depending on the case for which the Company has been appointed.

In this case, your personal data is processed on the following legal grounds:

  1. (a) Art. 6 paragraph. 1(b) of the RODO, which stipulates that the processing of personal data is lawful if it is necessary for the performance of a contract to which the data subject is a party, or to take action at the request of the data subject prior to entering into a contract – such a contract is an order for the provision of consulting services given to us by you or another person;
  2. (b) Art. 9 paragraph. 2(f) of the RODO, which provides that the processing of personal data is lawful when it is necessary for the establishment, investigation or defense of claims;
  3. (c) Art. 6 paragraph. 1 point ci art. 9 paragraph. 2(g) of the RODO, which provide that the processing of personal data is legal when such processing is authorized by specific laws – such laws may be individual procedural rules that indicate the specific scope of personal data that should be provided in connection with specific activities.
  4. (d) Art. 6 paragraph. 1(e) of the RODO and Art. 9 paragraph. 2(g) of the RODO, according to which personal data may be processed if it is necessary for the performance of a task carried out in the public interest or for reasons of important public interest.

In such a situation, the Company’s possession of your personal data, as a rule, will be a contractual or legal requirement, and without your personal data, it may not be possible for the Company to provide advice.

3) If the Company has obtained your personal data in connection with a concluded or likely to be concluded contract (e.g., employment or civil law contract) – then the performance or conclusion of this contract is the purpose of processing your personal data.

In this case, the legal basis for processing your personal data will be Art. 6 paragraph. 1(b) of the RODO, which stipulates that the processing of personal data is lawful if it is necessary for the performance of a contract to which the data subject is a party or to take steps at the request of the data subject before entering into a contract. The legal basis for the processing of your specified personal data will also be the fulfillment of legal obligations incumbent on the Company, as the controller of your data (Article 6(1)(c) of the RODO), e.g. in connection with the need to make tax settlements, Social Security, etc.

In such a situation, the Company’s possession of your personal data will, as a rule, be a contractual or legal requirement, and without your personal data it may not be possible to conclude or perform the contract.

Depending on the situation, the legal basis for processing your data may also be the consent you have given (Article 6(1)(a) RODO, Article 9(2)(b) RODO). In this case, withdrawal of your consent is free and possible at any time. Withdrawal of consent does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.

Your data will not be processed by automated means, including profiling.

 

How long will we keep your data?

Personal data will be processed until the activities described above are carried out, and unfortunately, it is not possible to provide one specific period for the processing of your data. If this issue is of concern to you, please feel free to contact the Company directly.

At the same time, however, we assure you that your personal data will not be processed for longer than required or permitted under applicable law.

 

To whom may we share your data?

In accordance with applicable law, we may transfer your data to entities that process them on our behalf or to other data recipients, in particular to IT companies that cooperate with the Company.

Your personal data will not be transferred to third countries within the meaning of the RODO. However, should it become necessary or reasonable, the transfer of your data to a third country will be carried out in accordance with applicable legal regulations.

 

Cookies

The service uses cookies. Cookies are small files stored on the end device of the user (e.g. computer, tablet, phone) – the person visiting the Website. Cookies are used to authenticate visitors, to correctly display the Website in a manner consistent with the visitor’s preferences, and to facilitate the use of the Website.

 

The entity placing cookies on the portal user’s end device and accessing them is the entity managing the Website – that is, the Company.

Cookies contain the name of the website from which they come, the length of time they are stored on the user’s end device and a unique number.
